WICHITA, Kan. (KWCH) - The case of a 33-year-old man facing charges that include first-degree murder in connection with a November shooting spree that the Sedgwick County sheriff described as “a rampage” is headed for trial. Jose Acosta is in the Sedgwick County Jail where other listed charges include interference with law enforcement, drug possession, criminal discharge of a firearm, criminal possession of a weapon by a felon, aggravated assault, aggravated robbery, aggravated assault of a law enforcement officer, battery and criminal discharge of a firearm.

A few days after the crime, Sedgwick County Sheriff Jeff Easter released a timeline of events from the night of Nov. 22 that resulted in one man’s death and left another man’s dog injured.

Easter said the incident started at 8:49 p.m. at Prospect Park when 40-year-old Myron Tucker was shot and killed. Minutes later, at 8:52 p.m., officers responded to a robbery in the 1400 block of N. Otis where a person had been pistol whipped and had their bicycle stolen.

Less than five minutes later, a man who lives in the 1400 block of N. Otis, said he was asleep in his bed with his dog when someone fired shots into his home. He was grazed and his dog was struck in the hind leg .

The sheriff’s office said Wichita police shot Acosta after he raised his weapon toward officers. He was hospitalized with injuries the sheriff’s office described as critical but non-life-threatening and was booked into the Sedgwick County Jail upon his release from the hospital.

The Sedgwick County District Attorney’s Office confirmed that Acosta’s arraignment in the case is set for April 9. The case is moving forward after a preliminary hearing laid out the case against him.
